As a Responsible Care® company, Eastman fully supports the objectives of the K-REACH Act stipulated by South Korea on Jan. 1, 2015. We are also fully aware of the obligations resulting from the implementation of the act.
One requirement of K-REACH is the annual reporting of imported chemical substances into Korea to the South Korea Ministry of Environment for volumes greater than one ton per year. This reporting obligation falls under the importer or the Korean manufacturer. In case the products are manufactured outside Korea, the act contains a provision for which the obligations under the act can be transferred to the Korean Only Representative (OR) for the foreign manufacturer. Eastman and its manufacturing companies have appointed the Eastman Chemical Korea Ltd office in Seoul as its OR under K-REACH.
The importer will be able to perform annual reporting, provided the supplier can provide the full composition of the product.
For products for which the 100% composition can be disclosed (see Table 1), the importer can request our office for the full composition by means of the Certificate of Composition (CoC). This certificate will enable the importer to fulfil the annual reporting obligations.
For products for which the composition cannot be disclosed due to confidential business information reasons, we conduct annual reporting on behalf of the importer through our appointed OR office in Seoul.
For these products (see Table 2), we need to receive from the importer:
Importers are responsible to provide accurate information to our OR office and will remain responsible for all other obligations subject to K-REACH, except in cases where different procedures are agreed on.
For products where we can provide the CoC, see Table 1. For products listed in Table 1, the annual reporting can be completed by the importer.
Any registration requirements for products supplied by Eastman subject to K-REACH (priority existing chemicals under K-REACH as published by the South Korea Ministry of Environment, public notice 2015-92 of July 1, 2015) will be communicated separately and may differ from case to case.
